Due Process for Classified Employees

Classified Employees Gain a Form of Due Process

Education Austin and AISD signed off in Consultation a new Due Process.  No longer can an employee be just let go.

The following is an abbreviated version of the new DCD-R LOCAL for Employment Practices for At-Will Employees.

  • Notification of potential termination :  The Supervisor will notify the appropriate Superintendant or Employee Relations coordinator of the recommendation for termination, thus explaining the situation and corrective interventions which have been used. Employee should call Education Austin immediately 472-1124.
  • Review of Proposed Termination:  The Supervisor must provide Employee Relations copies of supporting documentation, including such things as evaluations, corrective actions forms, memorandums of concern, directives in writting, summary memos, meeting summaries, investigation reports etc.
  • Meeting with Employee:  The Principal/Supervisor and the employee realations Coordinator will meet with the employee to explain pervormance concerns and to give the employee an opportunity to provide additional information. Do not attend this alone.  Take your representative from Eduction Austin.  Following the meeting a decision is made for the individuals employment status.
  • Legal Review:  The AISD Attorney will review the recommendation for termination.
  • Approval of the Termination:  The Supervisior of Recruiting and Staffing will give the final recommendation for Termination.
  • Notification of Termination:  The Employee Relations Coordinator will notify the employeee of the termination, including the right to appeal.  The appeal must be made in 5 working days.
  • Appeal Grievance: Human Resources will schedule this in 5 days.
  • Filing a Grievance:  If the employee's termination is upheld by Human Resources then a grievance may be filed pursuant to Board Policy DGBA (Local).  This will receive a jurisdictional referral to Level lll, the Superintendant or Designee.
